The Tier 0–5 ladder of legal agency

Six rungs of structure, from no paperwork at all to federated stewardship — climb only as the work compels, and no rung is a lesser place to stand.

A body already exists the day its founders agree to associate in service of The Goal. No government granted it that life and none can revoke it. Sovereignty is not conferred by a legal form; a legal form protects and serves something that is already there. So the question is never are we allowed to exist but the much smaller one: what does our work require us to do that we cannot do on a handshake?

The answer points to a rung.

• Tier 0 — no formal structure. Sovereign people gathering and working. A signed Field of Agreements and the trust between them, and nothing else. Most transformational work happens here, and many bodies thrive here indefinitely. Do not rush past it.
• Tier 1 — voluntary association. The agreements made explicit and signed: shared purpose, principles, mutual accountability. Seriousness without bureaucracy.
• Tier 2 — ecclesiastical or private membership association. A form traditions have used for millennia to protect freedom of assembly and shared practice, without the weight of incorporation.
• Tier 3 — fiscal sponsorship. When outside resources must be received and stewarded before an entity of one's own is warranted, an aligned body holds the financial infrastructure.
• Tier 4 — legal stewardship entity. For sustained complex work — land, employment, enterprise. Cooperatives, perpetual purpose trusts, benefit corporations, community land trusts, FSx. The word that governs is stewardship: these exist to allocate resources toward the Goal, never to accumulate.
• Tier 5 — federated stewardship. Bodies sharing infrastructure, resources and governance by agreement. This is how a civilization scales without a centre.

Two disciplines keep the ladder honest. Restraint: take up the lightest structure that properly serves the purpose, answer for the work immediately in front of you rather than the work imagined three years out, and when unsure start simpler — structure can always be added. The double life: internally a body is a sovereign voluntary association united by shared vision and agreements, and that is the real thing; externally it puts on a legal form the way a person puts on a coat. The entity is the Selectively Permeable Membrane between the sovereign body and the old world, letting contracts, resources and protections cross without changing what the body is. Keeping those two clear prevents most of the confusion that sinks young organizations, and it matters most in a time of crisis.

One rule governs every rung: does this structure serve our Purpose? If yes, keep it. If no, change it. And name in advance the event that will tell you it is time to revisit the form — a first lease, a first large sum, a first binding agreement, the next turning of the season.
